WhatsApp gets notice from Supreme Court in privacy case

The Supreme Court, while hearing a petition challenging the changes made last month in WhatsApp’s privacy policy, sent a notice to the company and sought its reply.
During the hearing, a bench headed by Chief Justice SA Bobde said that the privacy of the people must be protected in view of allegations that users’ data is shared with other companies.
The bench said that citizens are afraid of losing their privacy and people feel that their chats and data are being shared with others. The court said that we are concerned that ‘WhatsApp reveals the circuit of messages’. The court told the lawyers of Facebook and WhatsApp, “You will be two or three trillion companies but people love their privacy more than money. It is our duty to protect it.” The Chief Justice told them, “Let us tell you the same What we have heard and read. People think that if A sent a message to B and B sent it to C, then Facebook knows this whole circuit of messages “. During the hearing, WhatsApp lawyer Kapil Sibal and Facebook lawyer Arvind Datar denied the allegations and termed it as “false information”. Kapil Sibal, who appeared on WhatsApp, said that there is a special law (General Data Protection Regulations) in European countries, but it is not so in India. He said that if Parliament makes a law in this regard, the company will abide by it.
Solicitor General Tushar Mehta, appearing for the Central Government, said that companies cannot share the data of users and there should be data security.
At the same time, Shyam Dewan, the lawyer of the petitioner Internet Freedom Foundation, said during the hearing that the metadata is shared on a large scale for the benefit and it is a matter of concern for privacy.
Dewan said, “We celebrate that WhatsApp does not fall below its privacy criteria for users in India. They should be prevented from sharing the data with Facebook”.
Shyam Dewan said that the privacy of Indian users is being reduced compared to European users.
After this, the Supreme Court issued notices to WhatsApp and Facebook. Now the hearing in this case will be held after four weeks.
Shyam Dewan said in January this year that WhatsApp has come up with a new privacy policy that compromises the privacy of users in India compared to Europeans. Had filed and demanded a stay on it.
The new policy was to come into force from 8 February. Indian users were asked to accept the new policy. Now this deadline has been extended to 14 May. WhatsApp has more than 400 million users in India.

वॉट्सऐप को प्राइवेसी मामले में सुप्रीम कोर्ट से नोटिस

सुप्रीम कोर्ट ने वॉट्सऐप की प्राइवेसी पॉलिसी में पिछले महीने किए गए बदलाव को चुनौती देनेवाली याचिका पर सुनवाई करते हुए कंपनी को नोटिस भेज उनसे जवाब माँगा है. मुख्य न्यायाधीश एसए बोबड़े की अध्यक्षता वाली पीठ ने सुनवाई के दौरान कहा कि यूज़र्स के डेटा को दूसरी कंपनियों के साथ शेयर किए जाने के लगते आरोपों को देखते हुए लोगों की निजता की रक्षा अवश्य होनी चाहिए.
खंडपीठ ने कहा कि नागरिकों को अपनी प्राइवेसी ख़त्म होने की आशंका है और लोगों को लगता है कि उनके चैट्स और डेटा दूसरों के साथ शेयर किए जा रहे हैं. अदालत ने कहा कि हमें इस बात को लेकर चिंता है कि ‘वॉट्सऐप संदेशों के सर्किट को ज़ाहिर कर देता है’. अदालत ने फ़ेसबुक और वॉट्सऐप के वकीलों से कहा, “आप दो या तीन ट्रिलियन की कंपनियाँ होंगी मगर लोगों को पैसे से ज़्यादा अपनी प्राइवेसी प्यारी होती है. इसकी रक्षा करना हमारा कर्तव्य है. ” मुख्य न्यायाधीश ने उनसे कहा, “हम आपसे वही कह रहे हैं जो हमने सुना और पढ़ा है. लोग सोचते हैं कि अगर ए ने बी को मेसेज भेजा और बी ने सी को, तो फ़ेसबुक को संदेशों के इस पूरे सर्किट की जानकारी होती है”. सुनवाई के दौरान वॉट्सऐप के वकील कपिल सिबल और फ़ेसबुक के वकील अरविंद दतार ने आरोपों से इनकार करते हुए इसे “ग़लत जानकारी” बताया. वॉट्सऐप की तरफ़ से पेश हुए कपिल सिब्बल ने कहा कि यूरोपीय देशों में एक विशेष क़ानून (जनरल डेटा प्रोटेक्शन रेगुलेशन्स) है, लेकिन भारत में ऐसा नहीं है.उन्होंने कहा कि अगर संसद इस संबंध में क़ानून बनाती है, तो कंपनी उसका पालन करेगी.
केंद्र सरकार की ओर से पेश हुए सॉलिसिटर जनरल तुषार मेहता ने कहा कि कंपनियाँ यूजर्स का डेटा शेयर नहीं कर सकती और डेटा की सुरक्षा होनी चाहिए.
वहीं याचिकाकर्ता इंटरनेट फ़्रीडम फ़ाउंडेशन के वकील श्याम दीवान ने सुनवाई के दौरान कहा कि बड़े पैमाने पर मेटाडेटा को फ़ायदे के लिए शेयर किया जाता है और ये प्राइवेसी के लिए एक चिंताजनक बात है.
दीवान ने कहा, “हम ये मनाते हैं कि वॉट्सऐप भारत के यूज़र्स के लिए प्राइवेसी के अपने मापदंडों को नीचे ना गिरा दे. उन्हें डेटा को फ़ेसबुक के साथ शेयर करने से रोका जाना चाहिए”. श्याम दीवान का कहना था कि यूरोपीय यूजर्स की तुलना में भारतीय यूजर्स की प्राइवेसी को कमतर किया जा रहा है.
इसके बाद सुप्रीम कोर्ट ने वॉट्सऐप और फ़ेसबुक को नोटिस जारी किया. अब इस मामले में सुनवाई चार हफ़्ते बाद होगी.
श्याम दीवान ने इस साल जनवरी में कहा था कि वॉट्सऐप एक नई प्राइवेसी पॉलिसी लेकर आया है जिससे यूरोपीय लोगों की तुलना में भारत के यूज़र्स की प्राइवेसी के साथ समझौता होता है.इंटरनेट फ़्रीडम फ़ाउंडेशन ने वॉट्सऐप की नई प्राइवेसी पॉलिसी के ख़िलाफ़ सुप्रीम कोर्ट में याचिका दायर की थी और इस पर रोक लगाने की मांग की थी.
नई नीति आठ फ़रवरी से लागू होनी थी. भारतीय यूजर्स को कहा गया था कि वे नई नीति को स्वीकार करें. अब ये समयसीमा बढ़ाकर 14 मई कर दी गई है. भारत में वॉट्सऐप के 40 करोड़ से ज़्यादा यूजर्स हैं.
